1. Validity of Sales Terms<\/strong><\/p>\n

1.1. These sales terms apply to purchases of goods and services from the online store www.aiamajad.com<\/a> between the buyer and the company Tene Kaubandus O\u00dc.
1.2. In addition to these terms, legal relationships arising from purchases made through the Tene Kaubandus O\u00dc online store are governed by the Law of Obligations Act (LOA), the Consumer Protection Act (CPA), and other applicable laws of the Republic of Estonia.
1.3. Tene Kaubandus O\u00dc reserves the right to make changes to the sales terms. Such changes will be published on the website www.aiamajad.com<\/a>.
1.4. Product images in the online store are illustrative and may differ from the actual products.
1.5. Product descriptions may contain unintentional errors.
1.6. Tene Kaubandus O\u00dc has the right to withdraw from a sales contract made via the online store without sanctions and to not deliver the ordered goods or services in the following cases:
\n\u2013 the product is out of stock;
\u2013 the price or characteristics of the product have been displayed incorrectly due to a system error.
If Tene Kaubandus O\u00dc cannot fulfill the order, it will contact the buyer and refund any prepaid amount.<\/p>\n

\n

2. Prices<\/strong><\/p>\n

2.1. All prices in the Tene online store include 24% VAT.
2.2. The prices do not include the cost of delivery to the customer.
2.3. Prices are valid from the moment of order placement until the payment deadline of the order (1 day after the order is placed).<\/p>\n

3. Placing an Order<\/strong><\/p>\n

3.1. Add the desired product to the shopping cart.
3.2. To view your cart, click on \u201cOstukorv\u201d (Shopping Cart) at the top right corner of the website.
3.3. Fill in the required fields with your information.
3.4. To confirm the order, check the box for \u201cYes, I agree to the terms\u201d and click \u201cNext.\u201d
3.5. After placing the order, a confirmation email will be sent to you. A customer service representative will then contact you to clarify the necessary order details.
3.6. Orders placed in the Tene garden house online store are processed on business days (Mon\u2013Fri 9:00\u201317:00). Orders placed after 14:00 on Fridays are processed the following Monday.<\/p>\n

4. Entry into Force of the Sales Contract<\/strong><\/p>\n

4.1. Under the sales contract, Tene Kaubandus O\u00dc agrees to hand over to the buyer the existing, to-be-manufactured, or future-acquired goods and ensure the transfer of ownership. The buyer agrees to pay the amount indicated on the invoice and accept the goods.
4.2. Orders for which payment has not been received within 7 days will be canceled.
4.3. The sales contract enters into force once the payment has been received in the Tene Kaubandus O\u00dc bank account.<\/p>\n

5. Delivery<\/strong><\/p>\n

5.1. All products are located at Lihula mnt. 22b, 90510 Haapsalu.<\/p>\n

\n

6. Right of Withdrawal<\/strong><\/p>\n

6.1. After receiving the order, the buyer has the right to withdraw from the contract within 14 days without stating a reason. This 14-day right of return applies only to private consumers, not legal entities.
6.2. The buyer may inspect the product to assess suitability, similarly to trying it in a physical store.
6.3. The returned product must be complete (including original packaging and all items contained therein). If the product was part of a promotion, the entire set must be returned.
6.4. The buyer is responsible for any depreciation in value due to use of the product beyond normal inspection.
6.5. To return a product, a free-form withdrawal notice must be submitted to info@tene.ee<\/a> within 14 days of receipt.
6.6. The buyer must return the product within 14 days of submitting the notice or provide proof that the product was handed over to a logistics company.
6.7. Tene Kaubandus O\u00dc will refund all received payments without delay and no later than 14 days from receipt of the withdrawal notice.
6.8. All direct return costs are borne by the buyer.<\/p>\n

\n

7. Force Majeure<\/strong><\/p>\n

7.1. Tene Kaubandus O\u00dc is not liable for damage or delivery delays caused by circumstances beyond its control or which could not have been foreseen.<\/p>\n

\n

8. Processing of Personal Data<\/strong><\/p>\n

8.1. By entering data on the website and confirming, the buyer consents to the collection and processing of personal data (name, phone number, delivery\/home address, email) and its transfer to logistics partners for delivery purposes.
8.2. Tene Kaubandus O\u00dc may use the buyer\u2019s contact information for advertising and information purposes.
8.3. The buyer may at any time prohibit the collection and use of their data, except when necessary for fulfilling contractual obligations or delivering goods.
8.4. Encrypted data communication with banks during purchases ensures the security of bank credentials, which are not accessible to the online store.<\/p>\n

\n

9. Warranty and Complaints<\/strong><\/p>\n

9.1. Tene Kaubandus O\u00dc is responsible for non-compliance or defects of goods sold, which appear within two years from delivery.
9.2. The buyer must notify Tene Kaubandus O\u00dc of any defects within two months of discovering them, presenting the purchase invoice. The notice must be sent to info@tene.ee<\/a>. Failure to notify within this period releases Tene Kaubandus O\u00dc from responsibility.
9.3. If a defect is found, use of the product must cease immediately.
9.4. For defects within two years of delivery:
\n\u2013 During the first six months, it is presumed that the defect existed at the time of delivery;
\u2013 After six months, the buyer must prove the defect existed at the time of delivery;
\u2013 The buyer may request free repair, replacement, price reduction, or contract cancellation, depending on the nature of the defect.
9.5. To return a product, an email must be sent to info@tene.ee<\/a> describing the defect and including the invoice. Tene Kaubandus O\u00dc has the right to inspect the defect and determine whether it can be repaired, replaced, or requires return.
9.6. Tene Kaubandus O\u00dc is not liable for defects caused by improper use, natural wear, damage, or the buyer’s fault.<\/p>\n

\n

10. Miscellaneous<\/strong><\/p>\n

10.1. All agreements between Tene Kaubandus O\u00dc and the buyer, including sales contracts, are governed by the laws of the Republic of Estonia.
10.2. Any disputes arising from the use of the online store will be resolved in Estonian courts.
10.3. The valid purchase agreement includes these sales terms and can only be amended by mutual agreement between the buyer and Tene Kaubandus O\u00dc.<\/p>\n<\/header>\n<\/div>\n<\/article>\n
